TERMS AND CONDITIONS


1. General Provisions

1.1. These terms and conditions (hereinafter – the "Terms") govern the use of the website kidsfilmstudio.com (hereinafter – the "Website") and the provision of children’s filming services (hereinafter – the "Service").
1.2. The Service provider is SIA "RUNDMAN", registration No. 40103391744, legal address: Valdeķu iela 59 – 34, Riga, LV-1058, Latvia, e-mail: info@kidsfilmstudio.com, phone: +371 26347622 (hereinafter – the "Studio").
1.3. By submitting an application and/or making a payment on the Website, the child’s parent or legal guardian (hereinafter – the "Parent") confirms that they have read these Terms, agree to them and undertake to comply with them.
1.4. Only a person who is at least 18 years of age and is the child’s parent or legal guardian may register a child for the Service.

2. Description of the Service

2.1. The Studio organises the filming of children on a professional film set according to a script agreed in advance.
2.2. Number of participants: no more than 10 (ten) children take part in one filming project.
2.3. Allocation of roles: each project includes 2 (two) lead roles; all other participants receive supporting (episodic) roles. The role is specified and confirmed at the time of application, before payment is made.
2.4. The script is agreed with the Parents before the filming day. The Studio reserves the right to make minor changes to the script where necessary for the filming process.
2.5. The Service includes: filming according to the agreed script, a professional film crew and equipment, costumes and make-up (where provided for by the script), editing of the footage and a digital copy of the finished film.
2.6. The finished video is delivered to the Parent within 30 days after the filming day by sending a digital download link to the e-mail address provided by the Parent.

3. Registration and Allocation of Roles

3.1. Participation is reserved by completing the application form on the Website and making payment in accordance with Section 4.
3.2. Lead roles are allocated in the order of booking and payment — they are given to the first two participants who have booked and paid for participation in a lead role. If the Parent has paid for participation in a supporting role, a lead role is not guaranteed.
3.3. The Studio reserves the right to cancel or reschedule the filming day if the minimum number of participants — 6 (six) children — has not been reached. In such a case, the Parent is offered an alternative date or a full refund.
3.4. A place on the film set is considered reserved only after the participation fee has been received in full.

4. Price and Payment Procedure

4.1. The participation fee for a child is stated on the Website next to the specific project. Prices differ depending on the type of role (lead or supporting role).
4.2. All prices are stated in euros (EUR) and include value added tax where applicable.
4.3. Payment may be made by bank card on the Website or by bank transfer on the basis of an invoice issued by the Studio.
4.4. The participation fee is payable as a 100 % advance payment at the time of booking. The booking takes effect only once payment has been received in full.
4.5. If payment is not received, the booking is not confirmed and the Studio has the right to offer the place to another participant.

5. Cancellation, Rescheduling and Refunds

5.1. Cancellation by the Parent:

–         if participation is cancelled more than 14 days before the filming day — 100 % of the amount paid is refunded;
–         if participation is cancelled 7–14 days before the filming day — 50 % of the amount paid is refunded;
–         if participation is cancelled less than 7 days before the filming day, or in the case of a no-show — the amount paid is not refunded, as the Studio has already incurred costs for booking the set, the crew and the equipment.
5.2. In the event of the child’s illness, upon presentation of a doctor’s certificate, the Studio offers the child participation on another filming date free of additional charge.
5.3. Right of withdrawal (distance contract): in accordance with Regulation No. 255 of the Cabinet of Ministers of the Republic of Latvia "Regulations Regarding Distance Contracts", a consumer has the right to withdraw from a distance contract within 14 days. The Parent is hereby informed that the right of withdrawal does not apply where the service relates to a leisure event on a specific date, or where the service has been fully performed with the consumer’s consent before the end of the withdrawal period. By registering the child for filming on a specific date, the Parent agrees to this.
5.4. Cancellation by the Studio: if the filming is cancelled by the Studio (except in cases of force majeure), the Parent is offered an alternative date or a full refund of the amount paid within 14 days.

6. Parental Consent and Conditions of the Child’s Participation

6.1. By registering the child, the Parent confirms that:
–         they have the legal right to represent the child and to give consent to the child’s participation;
–         the child’s state of health allows them to take part in the filming;
–         they have informed the Studio of the child’s allergies, health conditions or any other circumstances that may affect participation.
6.2. The child is brought to the film set and collected after filming by the Parent or by an adult authorised by the Parent in writing.
6.3. During filming, one of the Parents may remain in the designated viewing area, without interfering with the filming process and following the instructions of the Studio’s staff.
6.4. The Studio ensures the supervision of the children during filming by qualified staff — no fewer than one adult per five children.

7. Rules of Conduct on the Film Set

7.1. Children and Parents must follow the instructions of the Studio’s staff, the safety requirements and the filming schedule.
7.2. Participants must arrive at the specified time. A delay of more than 15 minutes may result in the child’s role being reduced or the child being excluded from the relevant scene without a refund.
7.3. The Studio has the right to terminate the child’s participation if the child’s behaviour endangers their own safety or that of other participants, or significantly disrupts the filming process. In such a case, the participation fee paid is not refunded.

8. Use of Images, Video and Personal Data

8.1. The video footage and photographs produced during filming in which the child appears are used:
–         to create the finished film and deliver it to the Parents;
–         in the Studio’s marketing materials, on the Website and on social media — only with the separate written consent of the Parent.
8.2. Consent to the use of the child’s image for marketing purposes is given on a separate consent form and is not a condition of participation. The Parent has the right to withdraw their consent at any time by writing to info@kidsfilmstudio.com; withdrawal does not affect processing carried out before the withdrawal.
8.3. Children’s personal data (name, surname, age, health information, image) are processed in accordance with the EU General Data Protection Regulation (GDPR) and the Studio’s Privacy Policy published on the Website, solely for the purpose of providing the Service.
8.4. Parents are prohibited from photographing or filming other participants on the film set without the consent of those participants’ parents.

9. Intellectual Property

9.1. The copyright in the script, the filming materials and the finished film belongs to the Studio.
9.2. The Parent receives the finished film for personal, non-commercial use (family archive, sharing with relatives, publication on personal social media accounts). Commercial use of the film without the Studio’s written permission is prohibited.
9.3. The Studio may use the finished film or excerpts from it publicly only in accordance with the consent referred to in Clause 8.2.

10. Liability

10.1. The Studio undertakes to provide a safe filming environment and supervision of the children in accordance with the requirements of applicable law.
10.2. The Studio is not liable for the loss of or damage to the child’s personal belongings (phones, jewellery, etc.) during filming.
10.3. The Parent is liable for damage intentionally caused by the child to the Studio’s equipment, sets or costumes.
10.4. Neither party is liable for failure to perform its obligations due to force majeure (natural disasters, epidemics, orders of public authorities, etc.). In such a case, the filming is rescheduled to another mutually agreed date.

11. Dispute Resolution

11.1. Disputes are resolved through negotiation. Complaints must be submitted in writing to info@kidsfilmstudio.com; the Studio responds within 15 business days.
11.2. If no agreement is reached, the Parent has the right to contact the Consumer Rights Protection Centre of Latvia (www.ptac.gov.lv), to use the EU Online Dispute Resolution platform (ec.europa.eu/odr), or to bring the matter before the courts of the Republic of Latvia.
11.3. These Terms are governed by the laws of the Republic of Latvia.

12. Final Provisions

12.1. The Studio has the right to unilaterally amend these Terms by publishing the current version on the Website. Bookings that have already been paid for are governed by the version of the Terms in force at the time of payment.
12.2. If any provision of these Terms is found to be invalid, the remaining provisions remain in force.
